Orange Shirt Kid’s Mum is Suing Epic Games Over ‘Orange Justice’ Emote

After the numerous lawsuits over dance moves, Epic Games is yet again under fire by another lawsuit, this time by the mother of the Orange Shirt Kid over the dance move ‘Orange Justice’. What makes this lawsuit unique is that Orange Shirt Kid submitted his dance and clearly gave permission to include it in the game.

This was reported by Variety and the lawsuit states that Epic is responsible for ‘unauthorized misappropriation’ of the Orang Shirt Kid’s dance. The dance was submitted in Fortnite’s BoogieDown contest where Fortnite asked its fans to submit their dance moves which could become part of the game if they win.

Orange Shirt Kid deleted the Tweets later however the case is already pretty strong in Epic’s favor because BoogieDown contest terms and conditions clearly state that no winner will be paid any sort of prize or reward for their submissions apart from adding their dance moves in the game.

By submitting their dance moves to Epic, the submitting parties also agreed to hand over the rights to Epic Games so that they can easily use the dance moves in their game. Variety also noticed in the lawsuit that it did not state that Orange Shirt Kid submitted his dance video willingly which was actually the case.

In the submission video, the dance was originally named ‘the Random’ and the kid says at the end of the video ‘it’s also a great exercise move’ which was the tag line of ‘Orange Justice’ emote included in Fortnite. The dance move was never sold for money in the game separately and it was released as part of a free Battle Pass item.

The funny thing here is that ‘Orange Justice’ was never officially announced as a winner by Epic Games despite its popularity. It was only added to the game later after social media pressure to include the dance in the game since it was the clear winner in their eyes. An actual campaign was started to put the dance move in the game.

Earlier lawsuits for dance moves which were sent to Epic Games include Backpack Kid and his Floss Dance, Carlton dance from Fresh Prince of Bel Air and Rapper 2 Milly over his ‘Milly Rock’ dance. Out of all these cases, the Orange Shirt Kid lawsuit is the only one where the dance move was originally sent to Fortnite to be included with the owner’s approval and consent.

Out of all these lawsuits, three of them, Floss Dance, Carlton Dance and Orange Justice are being handled by the same firm Pierce Bainbridge Beck Price & Hecht LLP which makes it an interesting fact. They are probably trying to get as many people on board with them as possible to make their case strong against Epic Games.
