Polish Government Investigating CD Projekt Red Over Cyberpunk 2077

It appears like problems have not yet finished for CD Projekt Red despite several apologies and promises about fixing Cyberpunk 2077. Their latest woe comes in the form of a new investigation that is being launched by Poland’s Office of Competition and Consumer Protection (UOKiK). The Polish department will investigate CD Projekt Red about the launch issues of Cyberpunk 2077 and its condition on base PS4 and Xbox One consoles.

This was reported by Polish business newspaper Dziennik Gazeta Prawna along with UOKiK’s spokesperson Małgorzata Cieloch saying that the organization has approached CD Projekt Red and will carry out an investigation over the buggy launch of the game and what the developer is doing in order to fix the problems with the game. Their official statement says:

We will check how the manufacturer is working on the introduction of amendments or solution to difficulties preventing the game [to work] on different consoles, but also how it intends to act in relation to the persons who filed complaints and are dissatisfied with [their] purchase due to the inability to play games on owned equipment despite previous assurances [that it would].

After their initial findings, the department will further make a decision on the next step of the investigation. GamesIndustry.biz mentions that according to an analysis provided by Dominik Jędrzejko, an attorney from law firm Kaszubiak Jędrzejko Adwokaci ‘despite CD Projekt Red’s best efforts to fix the issues with Cyberpunk 2077, this might not be enough to prevent it from being accused of “unfair market practice.”

This might make it very difficult for the developer to further continue working as an independent publisher and developer because if the department rules against them, the developer might need to pay 10% of its annual income and/or impose funds. While this may be a terrible financial blow for the company, it is also hurting the company’s goodwill against any of their future projects as it will push away consumers and investors alike.

A class-action lawsuit is already in place against CD Projekt Red and Sony has already delisted the title from its PSN in order to prevent any further purchases by players on both PS5 and PS4 consoles. Microsoft is currently offering full refunds to anyone who wants to refund their copy of Cyberpunk 2077. We will just have to wait and see how things work out for CD Projekt Red and whether they are able to satisfy Poland’s Office of Competition and Consumer Protection.
